Lockdown lifted after explosion at Hawaii school

Officials in Hawaii say a lockdown has been lifted at a Big Island high school after a small bomb exploded outside an auditorium. No injuries were reported, and police say two minors are in custody.
Hawaii Department of Education spokesman Alex Da Silva says police and fire officials gave an all-clear just before 1 p.m. Thursday after finding no other devices on campus.
Da Silva says students resumed classes and are being let out at their normal time. The lockdown lasted less than two hours.
Da Silva says the homemade device is being described as a "bottle bomb."
He says it went off on a walkway leading to the auditorium. A class was in session in the auditorium, but nobody was near the explosion.

It wasn't clear if the device was meant to hurt anyone or if it was a prank.

Woman dies after scarf, hair get caught in Montreal subway escalator

A woman died Thursday after her scarf and her hair got caught in the teeth of a Montreal metro escalator and the scarf then apparently strangled her.
The Montreal Gazette reports that the incident occurred when the 48-year-old’s scarf got caught in the escalator Thursday morning.
“The woman’s scarf got caught in the escalator and then she bent down to try to get it out and her hair got stuck, too,” Constable Jean-Pierre Brabant told The Gazette.
“A bystander called 911 and by the time police arrived, she was declared dead.”
The Gazette said she apparently was strangled by the scarf.
Bob Lamle, a spokesman for Montreal's ambulance service, said Thursday he had never seen anything like it in his 30-year career.
“The firefighters, first responders, got there first and began resuscitation efforts. Our technicians arrived and took over but it was not viable and the woman was declared dead,” Lamle said.
There is an emergency stop button at the top and bottom of the escalator, as in all escalators serving the system. Constable Brabant said he did not know whether anyone pressed the stop button while the woman, who was not identified, struggled.
Metro users were shocked by the news that someone could die while doing something most of them do several times a day.
“Personally, I’m really traumatized because I use that escalator every day,” 13-year-old Philippe Silyutintold The Gazette as he was standing with friends outside the Fabre station entrance while police investigated. “I will be very careful now about any threads hanging down or shoe laces, for sure.”
An engineer who has been working on the escalators for the past nine years told The Gazette they are equipped with safety mechanisms that are supposed to prevent this kind of accident.

Feds to seek death penalty against accused Boston bomber Tsarnaev

The Justice Department has notified a federal judge that it intends to seek the death penalty if a jury convicts Dzhokhar Tsarnaev for last April’s bomb attacks at the Boston Marathon.
Tsarnaev is awaiting trial on charges that he and his brother built and planted two pressure-cooker bombs that killed three people and injured at least 260 others. He is also charged with killing an MIT campus police officer.
Attorney General Eric Holder said in a statement: “After consideration of the relevant facts, the applicable regulations and the submissions made by the defendant’s counsel, I have determined that the United States will seek the death penalty in this matter. The nature of the conduct at issue and the resultant harm compel this decision.”
Among the factors listed by the government were that the killings were intentional, resulted from acts calculated to cause grave risks to public safety, and were committed in a cruel manner. And prosecutors said the defendant has demonstrated no remorse.
“One way or another, based on the evidence, Tsarnaev will die in prison,” Massachusetts Gov. Deval Patrick said in a statement. “In each milestone of this case — today’s announcement, the trial and every other significant step in the justice process — the people hurt by the Marathon bombings and the rest of us so shocked by it will relive that tragedy. The best we can do is remind each other that we are a stronger Commonwealth than ever, and that nothing can break that spirit.”
Liz Norden, the mother of two men who lost legs in the bombing, praised the decision.
"You know, it just makes me relieved that the attorney general believes that it was a terrorist attack or it's the death penalty and we support the decision," Norden told MSNBC's Craig Melvin.
She noted that the Justice Department officials talked to victims' families before reaching the decision.
While most legal experts predicted the Justice Department would seek the death penalty, the decision will be somewhat controversial.
A poll conducted in September for the Boston Globe found that 57 percent of respondents favored a sentence of life without parole if Tsarnaev were to be convicted, while 33 percent thought death would be the appropriate punishment for the government to seek.
Executions in the federal system are rare.  In the modern era of the death penalty, since the U.S. Supreme Court forced a change in sentencing laws in the mid-1970s, the federal government has carried out just three executions.
Timothy McVeigh was put to death in 2001 for his role in bombing the Oklahoma City federal building in 1995. The most recent federal execution was more than a decade ago.
The federal execution system has been put on hold by a court battle over the combination of drugs used to administer a lethal injection. One of the drugs is no longer available, forcing the Bureau of Prisons to consider alternatives.
In the event of a conviction and a recommendation of a death sentence, the execution by lethal injection would be carried out at a federal prison in Terre Haute, Ind.
A trial date has not been set for Tsarnaev. His next hearing is Feb. 12.
Legal experts have said that seeking the death penalty against Tsarnaev could give him an incentive to plead guilty to avoid being put to death.

Amanda Knox convicted of murder in Italian retrial

American student Amanda Knox said Thursday that she is "frightened and saddened" after being re-convicted in the stabbing death of her roommate when they were students in Italy in 2007.
A panel of judges and jurors set a sentence of 28 years and six months for Knox, who returned to the United States after an earlier conviction was reversed. They also convicted her Italian ex-boyfriend, Raffaele Sollecito, sentenced him to 25 years and banned him from traveling.
"I am frightened and saddened by this unjust verdict," the 26-year-old said in a written statement from her home in Seattle, where she returned after spending four years in prison.
"Having been found innocent before, I expected better from the Italian justice system."
It's unclear what will happen to Knox, who is certain to appeal — a process that could take a year or longer. Even if the high court confirms the new conviction, Italy still would have to seek her extradition. She has vowed not to return.
Sollecito's lawyers said they were stunned by the latest twist in a whiplash-inducing case that has made headlines on both sides of the Atlantic for six years.
Knox and Sollecito were arrested after British student Meredith Kercher was found dead in a pool of blood in their apartment in the university town of Perugia, her half-naked body covered in up to 40 knife wounds.
Prosecutors argued that Kercher was killed in a sex game, and Knox and Sollecito were convicted and sentenced to 26 years.
Knox was also convicted of slander for falsely telling police she heard a Congolese bar owner kill Kercher — a claim that prosecutors say is evidence of her guilt but that she says was made out of fear during a high-pressure grilling.
In 2011, an appeals court reheard the case and acquitted Knox and Sollecito after independent experts said crucial DNA evidence had been contaminated by police.
But in March, Italy's highest court dismissed that acquittal — slamming the lower court for "contradictions and inconsistencies" in its decision — and ordered a new trial.
Although prosecutors claimed six years ago that Kercher was killed because she balked at participating in a drug-fueled orgy, they changed theories for the new trial and now say a simple argument sparked the violent frenzy.
Knox and Sollecito say that only one person is responsible for Kercher's death: small-time drug dealer Rudy Hermann Guede. The Ivory Coast-born man is serving 16 years for the slaying, but a court found that he did not commit the crime alone.
"As we've always said, we wouldn't want the wrong people put away and we certainly wouldn't want anyone who should be away out there free," Stephanie Kercher told an Italian TV station.
Her brother Lyle added: "The most important thing is to reach a final point in this case."
In her statement, Knox expressed "respect and support" for the Kercher family but insisted she was the victim of overzealous prosecution and character assassination.
"This has gotten out of hand," she said.
"Clearly a wrongful conviction is horrific for the wrongfully accused, but it is also terribly bad for the victim, their surviving family, and society."
Legal experts say it's unlikely that Italy would seek to extradite Knox before its supreme court rules on any appeals. Harvard Law Professor Alan Dershowitz said that if the conviction is upheld, the U.S. would have little choice but to send Knox to Italy to serve her sentence.
"The United States seeks extradition of more people than any country in the world. We’re trying to get [NSA leaker Edward] Snowden back and we’re not going to extradite someone convicted of murder?" he told NBC News.
Some observers have questioned whether the American protection against double jeopardy — being retried and convicted of a crime after being acquitted — would give the U.S. an excuse to balk at extradition.
But Dershowitz doubts that would apply in the Knox case because she was intially found guilty and her acquittal took place at an intermediate appeals level.
"If that happened in the U.S., it wouldn't be double jeopardy," he said.
Knox has said the prospect of another conviction haunted her as she tried to rebuild her life in the U.S.
"I imagine it all the time because I have to think the worst-case scenario,'' she told TODAY earlier this year.
"I have to prepare in my mind what that would be like. I thought about what it would be like to live my entire life in prison and to lose everything, to lose what I've been able to come back to and rebuild. I think about it all the time. It's so scary. Everything's at stake."
